Filing For A Divorce

Divorce is a Court-based process which is largely administrative in nature.

Specific forms and documents are required to be completed by both parties during the process and submitted to the Court at certain stages.

What you should know

 

From April 2022 the law has changed regarding filing divorce proceedings. A new law came into force creating a more amicable approach to divorce. The no fault divorce is a divorce process which does not require blame or wrongdoing by either party. None of the previous 5 grounds of divorce need to be proved.

The sole ground of divorce is irretrievable breakdown of the marriage.

The application can be made jointly with your spouse, or a sole application can be made.

There is a minimum period of 20 weeks from the start of the divorce
proceedings to when the conditional order is made. In addition, there is a further 6 weeks between the conditional order and when the final order is made dissolving the marriage.

The Divorce proceedings take at least 6 months from application to conclusion.

We charge £1073 for a divorce application which includes a £593 court fee and our fees of £480 including VAT.
